Tract 1: Presenting an exceptional 308.79 Acre +/- pivot irrigated farm located 8 miles north of Elm Creek and 2 miles west of the HWY 183.

Legal Description: West ½ of Section 13, Township 10 North, Range 19 West of the 6th PM, Dawson County, Nebraska

About: This property is situated approximately 8 miles north and 2 miles west of Elm Creek. This land is a combination of productive pivot irrigated and dry crop land. According to the assessor, the property comprises of 256.13 irrigated acres, 46.57 acres of dry crop land and 2.55 acre of grass. This tract is watered by two center pivots. This land is best accessible traveling 1 mile west of Miller on HWY 40, then turning on north on Arrow Road and traveling 1 mile north.

The property exhibits a range of soil types, including Coly silt loam, Holdrege silt loam and some Hobbs silt loam. Overall a productive mix for row crop production. The land is gently rolling terrain with center pivot irrigation. The well is located near the pivot point with underground pipe feeding the center pivot. The pivot is an 8 tower pivot and is owned by the tenant.

Terms

Method of Sale: The property sells at Absolute Live Auction. Online bidding will be offered to bidders who meet the qualifications. The property will be offered as individual tracts.

Payment: The winning bidder(s) will be required to make $200,000 non-refundable deposit on Tract 1 and $100,000 non-refundable deposit on Tract 2 the day of auction with the signing of an Adam Marshall Land & Auction, LLC purchase agreement. Wire transfer, certified or personal check accepted. The balance will be due at closing.

Closing: Closing to be on January 23rd, 2024 or sooner.

Possession: Full possession of the property will be given upon closing, subject to the current tenant’s lease. The buyer will receive full possession of the farmland March 1st, 2024.

Financing: This sale is NOT contingent upon buyer’s financing. Prospective buyers should make their financial arrangements prior to the auction.

Condition: This property is selling in “AS-IS” condition. There are no warranties expressed or implied to the condition of the property

Taxes: The 2023 and previous years real estate paid by the Seller. The 2024 and subsequent years will be the responsibility of the buyer.

Rents: All rents for 2023 will retained by the seller.

Title: Seller to convey title by warranty deed. Merchantable title will be made available. The cost of title insurance and escrow closing fees to be divided equally between the buyer and seller.
